Privacy Policy

How Crestwell handles information

Crestwell Systems respects privacy and only collects information needed to run this website, respond to enquiries, prepare website plans and proposals, deliver website projects, manage care plans, improve the site, and meet reasonable legal or business record-keeping requirements.

Information we may collect

  • Contact details such as name, email address, phone number, business name, and preferred contact method.
  • Project information such as website links, brief notes, brand assets, supplied copy, images, service details, testimonials, and approval feedback.
  • Communication and admin records such as emails, project notes, invoices, payment status, support requests, and care-plan history.
  • Website usage information such as pages visited, device type, browser type, referral source, approximate location, analytics events, and IP address.

How we use it

  • To respond to enquiries, recommend a website package, plan a build direction, and prepare proposals.
  • To plan, write, design, build, test, launch, maintain, and improve websites.
  • To manage client relationships, approvals, invoicing, support, reporting, security, and care-plan delivery.
  • To understand website performance, improve enquiry paths, and protect the site from abuse.
  • To send relevant updates where lawful, with an opt-out where direct marketing is used.

Cookies and analytics

This site may use essential cookies, analytics tools, forms, video/media tools, or security tools. These may collect technical usage data so the website can work properly and so Crestwell can understand what content is useful. You can manage cookies in your browser settings.

Sharing and storage

We may use trusted service providers for hosting, deployment, analytics, forms, email, project management, file storage, security, invoicing, and support. We do not sell personal information. Some providers may store or process information outside South Africa, in which case we aim to use reputable providers with reasonable safeguards.

Security and retention

We use reasonable technical and organisational measures to protect information. No online system is risk-free, but access is limited to what is needed. Records are kept only as long as necessary for enquiries, project delivery, support, care plans, accounting, legal obligations, dispute handling, or legitimate business administration.

Terms & Conditions

The terms for using the site and working with Crestwell

By using this website, submitting an enquiry, requesting a website project, or engaging Crestwell Systems, you agree to use the site lawfully and understand that final project scope, pricing, timelines, and deliverables are confirmed in a written proposal, invoice, statement of work, or service agreement.

Website information

  • The website provides general information about Crestwell's web studio services, packages, care plans, and approach.
  • Website content is not legal, tax, accounting, financial, or professional advice.
  • Pricing, services, package details, availability, and content may be updated or removed without notice.
  • Visuals, motion examples, interface mockups, and package examples are illustrative unless stated otherwise.

Projects, scope, and payments

  • A project starts after written approval and any required upfront payment or deposit has been received.
  • Package scope, revision limits, deliverables, payment terms, and timelines are defined in the accepted proposal or invoice.
  • Additional pages, copywriting, integrations, motion work, urgent work, third-party tools, or out-of-scope changes may be quoted separately.
  • Deposits and milestone payments cover planning, production time, project management, reserved capacity, and completed work.
  • Third-party costs such as domains, fonts, stock assets, hosting, licences, software, plugins, or contractors are not refundable once committed.

Client responsibilities

  • Clients must provide accurate business information, feedback, approvals, content, assets, and access on time.
  • Clients must have the right to use any logos, images, testimonials, copy, badges, credentials, and third-party materials they supply.
  • Clients remain responsible for the legal accuracy of claims, regulated wording, professional credentials, pricing, and industry-specific statements.

Ownership and limitations

Unless agreed otherwise, Crestwell retains ownership of its pre-existing systems, templates, methods, reusable code, internal tools, and know-how. After final payment, the client receives the agreed rights to use the completed website deliverables for their business. Crestwell does not guarantee rankings, traffic, revenue, or lead volume because those outcomes depend on many external factors.

Cancellations and care plans

If a project is cancelled after work begins, completed work, reserved capacity, and committed costs remain billable. Crestwell may consider partial credits only where clear undelivered work remains. Monthly care plans can be cancelled by written notice unless a minimum term is stated in the proposal, usually taking effect at the end of the current paid period.

Governing law

These terms are governed by the laws of South Africa. Any formal client agreement may include additional dispute-resolution terms.

POPIA

Your privacy rights and request process

Crestwell aims to handle personal information in line with the Protection of Personal Information Act, 2013 (POPIA) and related South African access-to-information principles. This section explains how to make a privacy or information request.

You may request that we

  • Confirm whether we hold personal information about you.
  • Give access to your personal information, where lawful and practical.
  • Correct or update inaccurate personal information.
  • Delete personal information where deletion is lawful and no longer conflicts with legitimate record-keeping duties.
  • Object to certain processing where the law allows an objection.
  • Withdraw consent where processing is based on consent.
  • Opt out of direct marketing.

How to submit a request

Email privacy@crestwellsystems.com with the subject line "POPIA Request". Include your full name, contact details, request type, and enough information for us to locate the relevant record. We may need to verify your identity before acting on the request.

PAIA access requests

If your request is a formal access-to-records request under PAIA, please provide enough detail to identify the record and the right you are trying to exercise or protect. A request may be refused where the law allows, and lawful request fees may apply.

Complaints

If you are not satisfied with how a privacy request is handled, you may contact the Information Regulator in South Africa. Crestwell will try to resolve reasonable concerns directly first.
